HOW IS FAULT DETERMINED IN A SLIP AND FALL ACCIDENT?

Determining fault in a slip or trip and fall case can be very complex. In most cases we must prove one of the
following to prove a defentant was negligent:
- The defentant causes the hazard.
- The defendant had actual notice that the hazard existed, meaning that they were actually aware of the problem.
- That the defendant had constructive notice of the hazard, meaning that the hazard existed for an enreasonable amount of time
so that they should have known of its existence.
